Welcome to XanaTrend (“XanaTrend,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of www.xanatrend.com (the “Site”) and any purchases, services, or features provided through the Site (collectively, the “Services”). By visiting the Site or purchasing from us, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, please do not use the Services.

1) Eligibility & Account

  • You must be at least the age of majority in your jurisdiction to use the Services.

  • Some features may require creating an account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately of unauthorized use.

2) Storefront, Products & Availability

  • Product descriptions, images, specifications, and pricing are provided for convenience and may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update information without prior notice.

  • We may limit quantities, discontinue products, or refuse any order at our sole discretion.

3) Pricing, Taxes & Promotions

  • Prices are shown in the currency stated at checkout and exclude applicable taxes, duties, and shipping unless noted. You are responsible for all taxes and duties imposed by your jurisdiction.

  • Promotional offers, coupons, and discounts may have additional terms, are non-transferable, and may be changed or discontinued without notice.

4) Orders & Payment

  • When you place an order, you are making an offer to buy the items in your cart. We may accept or decline any order. Order acceptance occurs when we send a confirmation email and charge your payment method.

  • We use third-party payment processors. By submitting a payment, you agree to their terms and authorize us to charge your selected payment method for the full amount (including shipping, taxes, and fees).

  • If we suspect fraud, abuse, or unauthorized activity, we may cancel or refuse an order and/or suspend or terminate your account.

5) Shipping, Delivery & Risk of Loss

  • Estimated shipping times are provided for convenience and are not guaranteed. Risk of loss and title for items pass to you upon our delivery to the carrier.

  • You are responsible for providing accurate shipping information. We are not liable for delays or losses due to incorrect addresses, customs holds, or carrier issues.

6) Returns, Refunds & Exchanges

  • Our Returns/Refunds policy (posted on the Site) is incorporated into these Terms. Please review it before purchasing. Where permitted by law, items must be returned in their original condition and within the stated window. Some items may be final sale or non-returnable for hygiene/safety reasons.

  • Shipping fees are generally non-refundable unless required by law or expressly stated otherwise.

7) User Content: Reviews & Submissions

  • If you post reviews, comments, photos, or other materials (“User Content”), you grant XanaTrend a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such User Content in connection with operating and promoting the Services.

  • You represent that your User Content is accurate and does not violate any third-party rights or laws. We may remove User Content at any time.

8) Acceptable Use

You agree not to:

  • use the Services for any unlawful purpose;

  • violate or infringe intellectual-property, privacy, or publicity rights;

  • upload viruses, malware, or harmful code;

  • interfere with or disrupt the Site’s security or operation;

  • use bots, scrapers, or other automated means without our prior written permission.

9) Intellectual Property

All content on the Site—including text, graphics, logos, icons, images, video, audio, product names, and software—is owned by XanaTrend or its licensors and is protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, modify, or create derivative works without our express written consent.

The Site may contain links to third-party websites or services. We do not control and are not responsible for third-party sites, content, or practices. Your use of third-party services is at your own risk and may be subject to additional terms.

11) Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

12) Limitation of Liability

To the fullest extent permitted by law, XanaTrend and its directors, officers, employees, agents, partners, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services or purchase of products. Our total liability for any claims will not exceed the amount you paid to XanaTrend for the product(s) at issue in the 3 months preceding the claim.

Some jurisdictions do not allow certain limitations, so the above may not apply to you to the extent prohibited by law.

13) Indemnification

You agree to defend, indemnify, and hold harmless XanaTrend and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms or your misuse of the Services.

14) Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share personal information. By using the Services, you consent to our data practices as described in the Privacy Policy.

15) Changes to the Services or Terms

We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time. When we do, we will revise the “Effective date” above and post the updated Terms on this page. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

16) Suspension & Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms or applicable law. Upon termination, your right to use the Services ceases immediately, but provisions that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, indemnification) will survive.

17) Governing Law & Dispute Resolution

These Terms and your use of the Services are governed by the laws of [Your State/Country], without regard to conflict-of-laws principles.
Disputes. Before filing a claim, you agree to try to resolve any dispute informally by contacting us at [email protected]. If we cannot resolve the dispute within 30 days, you agree that disputes will be resolved in the courts located in [Sheridan /Wyoming /United States] (unless mandatory law provides otherwise). Where allowed by law, you and XanaTrend waive the right to a jury trial and agree not to bring or participate in a class action.

18) Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severed and will not affect the validity and enforceability of the remaining provisions. These Terms, together with our Privacy Policy and any policies posted on the Site, constitute the entire agreement between you and XanaTrend regarding the Services.
